PROPOSED REGULATIONS

The Promotion of Equality and Prevention of Unfair Discrimination Act, 2000 (Act 4 of 2000) (The Act) was published in Government Gazette No. 20876 of 9 February 2000. In terms of section 35 of the Act, the Act shall come into operation on a date fixed by the President by proclamation in the Gazette. No date has yet been fixed. Information regarding the date of commencement will be made known at a later stage.

Section 30 of the Act deals with regulations and provides that the Minister may, and in certain circumstances must make regulations relating to various aspects. Draft regulations were formulated. You will note that the draft regulations do not cover aspects relating to the Promotion of Equality as envisaged in Chapter 5 of the Act. Draft regulations in respect of these aspects will be submitted at a later stage. You will also note that extensive regulations relating to assessors were formulated. This is due to the fact that the intended regulations in terms of the Magistrates Courts' Amendment Act, 1998 (Act 67 of 1998) have not yet been finalised. Your comment on the draft regulations and proposals ** relating to the time periods intended to be prescribed by the regulations where this appears in the draft regulations will be appreciated.

Kindly submit your comment and proposals on or before 28 July 2000 for attention Ms A Stelling***. Should no comments or proposals be received by the said date steps will be taken to finalise the draft regulations.
